General provisions

 The consumer, in the capacity of the buyer, concludes a purchase agreement with DIZAJN LEPTIR doo (hereinafter referred to as: the seller) in the capacity of the seller. Legal entities as buyers are subject to the application of the Obligations Act and the Electronic Commerce Act and the Consumer Protection Act does not apply to them. These Terms of Use apply to legal entities in the part relating to the main characteristics of the product, the procedure for concluding a contract, the price of the product, the method of payment and shipping of the product, the description of the method of delivery of the product, delivery costs, general information. The seller may, at its discretion, provide the legal entity with the rights of a buyer who is a consumer in each specific case. The user is a person who uses the Seller's website www.papillon.hr , as well as any buyer and visitor to the Seller's website. The conclusion of a purchase agreement via the Seller's website is regulated in accordance with legal provisions, taking into account in particular the principles and provisions of the directives and regulations of the European Union. The conclusion of a contract via the Seller's website constitutes the conclusion of a distance contract. These Terms of Use also constitute a pre-contractual notice when a purchase and sale contract is concluded by a consumer, or any natural person who concludes a legal transaction or operates on the market outside their trade, business, craft or professional activity, and if the contract is concluded between a trader and a consumer within the framework of an organized system of sales or provision of services without the simultaneous physical presence of the trader and the consumer in one place, whereby up to the moment of concluding the contract and for concluding the contract, one or more means of distance communication are exclusively used. Means of distance communication are all means that can be used to conclude a distance contract without the simultaneous physical presence of the trader and the consumer, such as the Internet and e-mail. The content of the Seller's website is available in Croatian and English. The official language for concluding a purchase and sale contract is Croatian. We invest in the development of the review process. Our reviews are subject to verification of the identity of users and we make efforts to ensure that the published reviews originate from consumers who have actually used or purchased the product. We do not practice or encourage the submission of false consumer reviews or recommendations, ordering another legal or natural person to submit them, or misrepresenting consumer reviews or social recommendations for the purpose of promoting a product. We have no influence on reviews left via Google and Facebook accounts, and we cannot influence their technical settings regarding the verification of the identity of users providing reviews. General Information Website users are required to familiarize themselves with these Terms of Use before using the Seller's websites.   By accessing the website or using any part of its content, the user accepts the Terms of Use of the website, as well as all other rules and conditions of use of the websites in question and the services provided through them. Users agree not to use the websites in a way that harms the authors or third parties and accept all risks of using the websites and services. If the user does not agree with the above, he is obliged to stop using the websites and services provided through them. The content of the websites is protected by copyright. Changing, lending, selling or distributing content is possible only with the prior written permission of the Seller. The Seller enables the use of the websites in the best possible way. This includes: monitoring server operation, expanding capacity according to the number of users, supporting users and eliminating possible errors and problems in the operation of the system. The Seller does not assume responsibility for possible problems in the operation of the websites and services. The Seller cannot guarantee that the use of the websites will be uninterrupted or error-free. The user agrees that access to the websites may sometimes be interrupted or temporarily unavailable. Users use the websites at their own risk. The Seller is in no way liable for any damage that the User may suffer from using its website. The authors and other natural or legal persons involved in the creation, production and distribution of the Seller's website are not liable for any damage resulting from the use or inability to use the same. The Seller reserves the right to disable access to the website www.papillon.hr to users in the event that it is assessed that they are being used in an inappropriate manner. The Seller reserves the right to deny access to the website www.papillon.hr to anyone, based on its own assessments. The User undertakes to use the website in a manner that does not endanger the resources and services in their entirety. Inappropriate use of the website www.papillon.hr is prohibited and results in the termination of access to the same. 

Products and prices

Main product features - The customer becomes familiar with the main product features on the website www.papillon.hr

The Seller reserves the right to change information, including product prices and special offers on the website without prior notice. The product image is accompanied by a description of the main features of the product and its price including VAT. Prices, payment terms and special offers are valid only at the time of order and/or payment. The purchase is made by ordering the product that the buyer chooses based on the photo and basic description. The photos are illustrative in nature and may not always correspond to the products in all details, for example due to application settings, device screen, color perception, method of photography, etc. The described possible discrepancy between the product in the photo and the delivered product does not represent a material defect of the product. The Seller does not exclude the possibility of an error in stating the product price or special offer and apologizes to the buyers in advance if the above occurs. In such a case, the Seller will inform the buyer of the error and the impossibility of delivering the product. The procedure for concluding a contract The purchase is made on the Seller's website www.papillon.hr by filling out the form provided for this purpose. 

Order

When filling out the form, the buyer is required to enter all the information requested. The purchase can be made with the buyer's confirmation that he has previously read and understood the Terms of Use, that he has agreed to them and that he is aware that this is an order with an obligation to pay. When the buyer selects a payment method, it is necessary to click the "Order" button. The purchase is possible 24 hours a day, 7 days a week. The Seller is not responsible for the costs of using computer equipment and telecommunications services required to access the service. The buyer will be notified by e-mail of the order confirmation and the sending of the package. In the event that the Seller is unable to deliver any of the ordered products for any reason, an employee of the Seller will contact the buyer by phone or e-mail for the purpose of agreeing on the delivery of a replacement product or possible cancellation of the ordered product, or termination of the contract. The purchase of products on behalf of and for the account of a minor or a person deprived of legal capacity (fully or partially) can only be requested by their legal representatives. Purchases are made by ordering available products, which the customer selects based on the photo and basic description. The photos are illustrative in nature and may not always correspond in all details to the available products.

Along with the description of individual products, there are also technical characteristics of the products with approximate size measurements. The seller is not responsible for the 100% accuracy of the stated size measurements, as these are handmade compositions.

 By clicking on the “ADD TO CART” icon, the selected product is added to the cart. By placing the product in the cart, the product is not reserved, ordered or purchased. The customer can continue adding products or review the cart by clicking on “Cart”. 

When the buyer completes the product selection process by clicking on “Cart”, he will be redirected to the page where the products in the cart are given an overview. On the “Payment” option, the buyer selects the payment method. If the buyer agrees to purchase the products in the cart, he can click on the “Order” icon. After the buyer places the order, the seller will send a confirmation of receipt of the order to the buyer's email address along with the order number confirming that the buyer's order has been received and is in the processing process. The seller will send the buyer a notification to his email address with confirmation when the package has been sent. 

If the buyer does not receive the ordered products that he paid for within the agreed delivery period, he is obliged to notify the Seller of the same at the e-mail address: design@papillon.hr

 If the buyer has not received a purchase confirmation via email, he/she is required to contact the seller at the email address design@papillon.hr.

Payment method

Product price, method of payment and shipping of products The buyer undertakes to pay for the ordered products using one of the following payment methods: ● card payment ● bank transfer● cash on delivery

 We accept the following cards: ● Mastercard ● Maestro ● Visa ● Visa Premium ● Diners The agreed purchase price includes VAT and is expressed in euros (€). Please note that the means of payment in the Republic of Croatia is EUR (€) and the buyer pays the cost of currency conversion.

 

Product delivery method

 Product delivery is carried out via GLS (GLS Croatia doo) delivery service. The seller delivers within the European Union to the following countries: Austria, Belgium, Bulgaria, Czech Republic, Denmark, Finland, France, Greece, Croatia, Italy, Ireland, Luxembourg, Hungary, Netherlands, Germany, Poland, Romania, Slovakia, Slovenia and Sweden. 

  The seller hands over the package to the delivery service within 3 days of receiving the order. The seller strives to hand over all orders received by 12 noon on a working day (Monday to Friday) to the delivery service on the same day. The delivery time for packages within the Republic of Croatia is 1-2 working days from the day the package is handed over to the delivery service. For islands, the delivery times advertised on the official website of the GLS courier service apply: https://gls-group.com/HR/media/downloads/Raspored_dostava_na_otoke.pdf The delivery time for packages outside the Republic of Croatia is 1-2 working days for Slovenia, and 2-5 working days for other EU countries where Papillon shop delivers goods, from the day the package is handed over to the delivery service. The delivery time may be longer than previously stated during busy holiday periods and in emergency situations. Information on the required package transport time and information on delivery to the islands is available on the GLS Croatia website or from the GLS Croatia customer service. As part of GLS delivery services, the customer can choose the option of having the package delivered to a selected PaketShop store and Paketomat within the territory of the Republic of Croatia. The customer must pick up the package within 5 working days at the selected PaketShop store / Paketomat. 

The Seller checks the correctness of the ordered product before each delivery. The products will be packaged and protected so that they cannot be damaged by normal handling during transport. The Buyer is obliged to take delivery of the shipment and inspect it in front of the delivery person, all in order to avoid subsequent complaints due to the possibility of damage to the shipment during delivery, and to immediately complain to the delivery worker who delivered the goods, or refuse to take delivery of a shipment on which external damage is visible. The Buyer is obliged to sign the delivery note when taking delivery of the goods and state all remarks related to the delivery on the delivery note (damage to the packaging, shortages, etc.) and then hand it over to the delivery person, who will take it as confirmation of delivery/takeover. If the Buyer does not take delivery of the product or refuses to take delivery of the product without a valid reason, the Seller reserves the right to demand reimbursement of the costs of handling, transport and other possible costs. The Seller keeps unclaimed packages for a maximum period of up to 7 days from the failed delivery/notification of takeover, during which the product can be taken over by agreement. After that, the contract is considered terminated and the money paid for the product will be refunded. If the Seller is unable to deliver the ordered product, it will notify the buyer. The buyer can cancel the order or wait until the product is available again. If the Seller is unable to deliver the product within the agreed period, it will notify the buyer, who is obliged to allow him a subsequent reasonable period for the fulfillment of the purchase contract. 

 Shipping costs

The Buyer is obliged to inform the Seller of the existence of visible defects within 7 days from the date of receipt of the goods if he has discovered the defect, and no later than 14 days when the time of transfer of risk to the Buyer occurs. When, after receipt of the item by the Buyer, it turns out that the item has a defect that could not be detected by a normal inspection upon receipt of the item. Material defects for which the Seller is liable: (1) for material defects of the item that it had at the time of transfer of risk to the Buyer, regardless of whether he was aware of it. (2) for those material defects that appear after the transfer of risk to the Buyer if they are a consequence of a cause that existed before that. A defect exists: 1) if the item (arrangement) does not correspond to the description and type as determined by the purchase contract, 2) if the item (arrangement) does not correspond to the quantity 

3) If it is determined that there is material damage to the arrangement/composition 

 The Seller may have one of the following obligations, all in accordance with the provisions of the Obligations Act at the consumer's choice: ● removal of the defect, ● delivery of another product without the defect, ● price reduction. The Buyer may terminate the contract only if he has previously given the Seller a subsequent appropriate deadline for the fulfillment of the contract. The Seller has the right to refuse to remove the defect if repair and replacement are impossible or would cause disproportionate costs, taking into account all the circumstances, in particular the value of the thing without the defect, the significance of the defect and the question of whether the repair or replacement can be carried out without significant inconvenience to the Buyer. The Buyer may terminate the contract without setting a subsequent deadline if the Seller, after being notified of the defects, has informed him that he will not fulfill the contract or if it is obvious from the circumstances of the specific case that the Seller will not be able to fulfill the contract even within the subsequent deadline, as well as in the case where the Buyer, due to the Seller's delay, cannot achieve the purpose for which he concluded the contract. If the Seller fails to fulfill the contract within the additional period, it shall be terminated by law, but the Buyer may maintain it if he/she declares to the Seller without delay that he/she maintains the contract in force. If the defect is insignificant, the Buyer does not have the right to terminate the contract, but he/she is entitled to other rights from liability for material defects, including the right to repair the damage. The burden of proof that the defect is insignificant lies with the Seller. The costs of eliminating the defect and handing over another item without the defect shall be borne by the Seller. When the Buyer is a legal entity, the rules on material defects prescribed by the Obligations Act apply to it, and the rules from this section "Material Defects" do not apply to it. Notice on the method of submitting a written consumer complaint In accordance with Article 10 of the Consumer Protection Act, the consumer may send all complaints by post to the address: DIZAJN LEPTIR doo Ribnjak 20, 10 000 Zagreb or by e-mail to design@papillon.hr

In order for the Seller to respond to a written complaint that was not sent to the consumer by e-mail, consumers are asked to provide accurate information about their name and surname and the address to which the response will be delivered. The Seller must legally provide a response to the consumer's complaint in writing no later than 15 days from the date of receipt of the complaint. In the event of a dispute, the Seller and the consumer will resolve the dispute amicably, and if this is not possible, the competent court with subject matter and territorial jurisdiction shall have jurisdiction, applying Croatian law. Dispute resolution is possible before the Court of Honor of the Croatian Chamber of Commerce or other mediation centers.

 The goods that the buyer intends to return within 14 days must not be modified, used, removed from the protective film, or taken any action that would reduce the value of the goods. During the period in which the consumer exercises the right of return, the goods must be stored with due care, that is, he must behave as a particularly careful and conscientious person. During the period in which the consumer exercises the right of return, the goods must be stored with due care. 

Cancellation

          The Consumer Protection Act regulates order cancellation.

 This Privacy Policy (“Policy”) explains how PAPILLON SHOP collects, uses and manages your personal data contained on the website and which is available to PAPILLON SHOP through the use of the website: www.papillon.hr PAPILLON SHOP as the service provider of the website www.papillon.hr is committed to protecting the privacy of personal data.

PAPILLON SHOP is committed to protecting and respecting your privacy. Please read this policy carefully to understand why and how we collect your personal information and how it will be used. How and when do we collect your personal data?

We collect your personal data when necessary to fulfill your consumer needs or for our business purposes:

  1.  a) while you use our website, we collect types of data such as the date and time you access the page, information about the hardware, software or internet browser you use as well as your computer's operating system and application versions and your language settings. We may collect information about clicks and your access to the design@papillon.hr page that is displayed to you,
  2.  b) when you access the papillon.hr website, we will collect your IP address, which is also considered personal data,
  3. c) when opening a user account, PAPILLON SHOP will request the provision of certain information (personal data) such as first and last name, address, country, city, postal code, e-mail address, telephone number, username and password,
  4.  d) the buyer or user of our website, by entering their personal data after registration, or in the case of a purchase, enters into a contractual relationship that is the basis for the purchase of products and ordering services of the buyer's choice on papillon.hr . The processing of your personal data in the latter case is necessary for the execution of the contract in which you are the buyer or user party or in order to take actions at the user's request before concluding the contract. You can shop on wwwww.papillon.hr without being our registered user, but we definitely need information about your name, surname, address (place of residence), country, telephone number, e-mail address, payment method (IBAN), delivery address
  5.  e) when registering a person as a user or recipient of the newsletter or other information about our products and promotions. As the data controller, we will ask you to enter information (personal data) such as e-mail address, first name, last name and telephone number (the latter three types of data are marked as optional). The legal basis for processing your data in this case is consent. Therefore, a user who registers to receive information about our products and promotions by entering their data on the hpapillon.hr website gives the opportunity to process their personal data.   12.  when you ask us a question related to our offer, we will process your contacts and/or other data you provide to us when sending the question,

PAPILLON SHOP recommends that all customers or users of the site take care of their login password for their user account. We recommend that when choosing a combination of characters for the password, be sure to combine uppercase and lowercase letters and numbers. Use a password of at least six characters. We recommend changing the password periodically (at least once a year).

Please pay attention to the mandatory scope of data we are asking you for (marked *) because in the event that the buyer or user does not provide the requested information that is determined as mandatory in order to perform your requested or expected activity, unfortunately, you will not be allowed to participate in it; without the requested data, the activity will not be technically carried out.

Processing of personal data in the payment process

 At the time of payment on the website www.papillon.hr , as a condition for paying for products and services by credit or debit card, PAPILLON SHOP requests data from the customer to activate the payment process. When paying through contracted providers of processing and collection services (credit or debit) cards, contractual partners of PAPILLON SHOP as Processors or Independent Managers of personal data processing, your data will be shared.

For the above purpose, your personal data as a customer (e.g., customer name and surname, customer address, customer card details) are temporarily stored with the processing and payment service provider (MasterCard, American, Diners Discover, PayPal application, etc.), which stores this data in accordance with the highest level of protection and confidentiality.

Data processing when making a payment is necessary in order to perform all actions preceding the purchase or conclusion of a contract with the data controller. When we talk about the legal basis for data processing related to certain types of payments or legal entities that provide the aforementioned services, payment data such as name, surname, code, amount, account number or other transaction codes are shared with the card company or bank or third party through which the payment is made, all at the request of the respondent who independently selects the payment method.

PAPILLON SHOP does not at any time dispose of, collect or process personal data entered for the purpose of processing and charging the card.

PAPILLON SHOP warns customers to take care of the information provided on the card so that it is not available to third parties and is not misused.

So, to summarize all of the above, we mainly collect your personal data directly from you either to enter into a contract with us, to perform an action at your request, when you order certain products or services or fill out a certain form, or when you want to receive our newsletter and be our registered user.

We do not use your personal information for marketing purposes unless you tell us that you agree to this. If you would like us to send you details of our products, services, offers and promotions, please subscribe to this by giving us your consent when subscribing to the newsletter.

What data do we collect directly from you and for what purpose?

Typical categories of data we collect from users are as follows: name, billing address, shipping address, financial information including credit, debit card information or other payment information that you provide when filling out forms on the websites or when communicating with us by phone or email.

All authorized persons sign a confidentiality statement.

The data collected for the purposes set out in these rules will be stored only for as long as is necessary to fulfil the stated purposes. Your personal data will not be kept in a form that allows you to be identified for longer than PAPILLON SHOP reasonably considers necessary to achieve the purpose for which it was collected or processed. PAPILLON SHOP will keep certain personal data for the period of time prescribed by law or regulation that obliges PAPILLON SHOP to keep the data 

How long will PAPILLON retain your personal data?

PAPILLON SHOP will not retain your personal data for longer than the period for which the data is necessary to fulfill the purpose of their use, and for a maximum period of 3 years, except in exceptional cases when a longer data retention period is prescribed by law (for example, we will retain data related to unilateral termination of the contract and consumer complaints for 1 year, data related to the exercise of your privacy rights will be retained permanently, data related to prize games will be retained for 5 years, while we will retain account data for 11 years).

    There has always been a tendency to decorate all the spaces in which I stayed and lived. There was a lot of it during the years of living and traveling the world. And there is not only a need for the final and last touch of decorating the interior through decoration, but also for interior design planning and more serious construction interventions. In addition to innate aptitude and experience, knowledge and education are always needed. I spent a year working with an interior designer from Boston, learned a lot, broadened my horizons. She continued her education at an Italian design school and since then we have been providing interior design services with great pleasure and love.
    The team is made up of experienced professionals - from architects when necessary, civil engineers or statics to trade professions; upholsterers, carpenters, electricians, plumbers, painters, ceramicists.
    In addition to interior planning from the initial conceptual design, we also offer 3D projection and all other necessary work up to the same final performance:

    We design and create decorations from fresh flowers for corporate and private clients, which includes the decoration of private celebrations (weddings, birthdays, parties) and business celebrations (events, openings, receptions, promotions) and others.
    Do not forget that the photos of one of the most important days of your life do not talk about food or drink, but your wedding dress or suit, the bouquet in your hands and the magical impression of the decorated space will forever remain one of the most beautiful memories.

    How to engage us and what is our price? At your invitation, we come to the site and do not charge for that visit. After getting acquainted with the work task and your wishes, we create an idea about the type of decoration and prepare a cost estimate. After your approval of the cost estimate, we start the implementation.

    Note : you will make cooperation easier if you determine the approximate cost estimate in advance.
